Please read these Terms & Conditions (“Terms”) carefully before using CourtOps (the “Platform”), operated by BYWGlobal LLP (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms.
1. About the platform
A subscription-based SaaS platform that helps badminton academies and sports venues manage bookings, batches, memberships, and payments.
The Platform is offered as a software-as-a-service subscription to sports venues and academies (each, an “Operator”). Subscribers of an Operator (parents, players, members) may use the Platform to view their bookings and pay invoices issued by the Operator.
2. Accounts
To access the Platform you must sign in with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Operators may grant access to additional users (coaches, front-desk staff) within their tenant scope.
3. Payments
The Platform integrates with regulated payment service providers to collect payments from subscribers on behalf of the Operator. BYWGlobal LLP acts purely as a technology facilitator and does not itself hold subscriber funds. Settled funds are credited to the Operator’s bank account by the payment service provider as per their own terms and timelines.
Pricing of services (court bookings, batches, memberships, etc.) is set by the Operator and displayed in Indian Rupees (INR). All platform-collected payments are processed in INR.
4. Refunds & cancellations
Refunds and cancellations are governed by our Refund & Cancellation Policy, which forms part of these Terms.
5. Acceptable use
You agree not to:
- use the Platform for any unlawful purpose;
- attempt to gain unauthorised access to any portion of the Platform, another tenant’s data, or the underlying infrastructure;
- upload, transmit, or share any content that is illegal, infringing, harassing, or harmful;
- interfere with or disrupt the Platform, its servers, or its networks;
- resell or sublicense the Platform without our prior written consent.
6. Intellectual property
All right, title, and interest in and to the Platform (excluding content uploaded by Operators and subscribers) is and remains the exclusive property of BYWGlobal LLP. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform during your subscription term, subject to these Terms.
7. Privacy
We process personal information (such as your name, email, and phone number) to provide the Platform, communicate with you, and process payments. Operator data is segregated by tenant and visible only to users authorised by that Operator.
8. Disclaimer of warranties
The Platform is provided “as is” and “as available”. To the maximum extent permitted by applicable law, BYWGlobal LLP disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall BYWGlobal LLP be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform. Our aggregate liability for any claim arising out of these Terms shall not exceed the amounts paid by you (or your Operator on your behalf) to BYWGlobal LLP for the Platform in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the Platform at any time without notice if we reasonably believe you have breached these Terms or applicable law. You may stop using the Platform at any time; an Operator may also revoke a user’s access within their tenant.
11. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Coimbatore, Tamil Nadu, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.
12. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when these Terms were last revised. Your continued use of the Platform after a change constitutes acceptance of the revised Terms.
